Terms and conditions.
The owner and operator of this shop is Kristen Marsh (ABN 69 913 110 851) trading as The Real Krissy Marsh Cookbook. By purchasing through this website you (the Customer) agree to the following terms of sale.
1. Ordering
1.1 On confirming a purchase order, the Customer agrees to buy the products in their bag at the listed price including GST and any postage and handling charges.
1.2 Products are sent as soon as practicable after payment is received.
1.3 The Customer warrants that products are not purchased for commercial resale.
2. Defective products
2.1 A defective product must be returned within 30 days of receipt with a copy of the invoice and a brief note identifying the defect and the Customer's details.
2.2 If the product is defective, we will at our discretion replace it or refund its price.
2.3 We accept no liability for defective products not returned in accordance with clause 2.1.
2.4 Our maximum liability never exceeds the price of the product the claim concerns.
3. Stock availability
3.1 The Customer is not entitled to object if product information on the website is incorrect, if advertised products are unavailable, or if product images differ from the actual products.
3.2 If the Customer pays for a product we cannot supply, the price of that product is refunded.
4. Products sent to an incorrect address
4.1 We are not liable for products not received within 40 days of purchase unless the Customer notifies us within that time.
4.2 If a product is not received because we sent it to an incorrect address through our own error, we will resend, replace or refund it.
4.3 If a product is not received because the Customer gave an incorrect or insufficient address, then if the product is returned to us we will resend it once the Customer pays the postage and handling for resending; if it is not returned to us we have no further responsibility.
5. Unclaimed products
If products are returned to us by someone other than the Customer and we cannot, despite reasonable efforts, contact the Customer, or the Customer does not contact us within 30 days of the return, the products may be disposed of and no refund is payable.
6. Governing law
These terms are governed by the laws of New South Wales, Australia, and nothing in them limits rights the Customer has under the Australian Consumer Law.
